And this particular court came to the same conclusion as the FCC on a critical TCPA issue, even though it expressly acknowledged it didn’t have to. Yet the amount of work that went into the analysis–none of which would have been needed a mere 6 days prior to the decision-really calls into question the wisdom of killing Chevron.
